Terms of Service

1. The agreement
By creating a workspace at app.fastbuyr.com or using the service, you agree to these terms. If you are accepting on behalf of a company, you confirm you are authorised to bind it.
These terms work alongside our Privacy Policy, which describes what we do with data.
2. Your account
You are responsible for the credentials to your workspace and for everything done under it, including by people you invite. Tell us promptly if you believe an account has been compromised.
You must give accurate registration details, be at least 18, and not share a login between people — invite them instead, so the audit log means something.
Workspace owners and administrators can add, suspend and remove users. Removing a user does not remove the data they created.
3. Acceptable use, and why it falls to you
Cold email sent through this product goes out from your own connected mailbox, under your own domain and your own sending reputation. We are never in the sending path and we never relay your mail through our own accounts. That is a deliberate design choice, and its consequence is that compliance is yours: it is your domain that suffers if you send badly, and your obligation under the law that applies to you.
You agree that you will not use the service to:
- send messages in breach of the anti-spam and electronic-communications laws that apply to you or to your recipients, including India’s IT Act and TRAI regulations and, where relevant, GDPR, CAN-SPAM and CASL;
- contact people whose details you obtained unlawfully, or in a way that breaches the terms under which you obtained them;
- ignore an unsubscribe request, remove the unsubscribe route from your messages, or re-add somebody who has opted out;
- send anything unlawful, deceptive, defamatory, harassing, or that impersonates another person or organisation;
- harvest personal contact details from social platforms, forums, comment threads or group chats; the discovery features are for publicly listed business contact details and are built to refuse the rest;
- attempt to bypass a website’s robots.txt, a platform’s automation limits, or any rate limit, quota, warm-up ramp or safety control in this product;
- resell, sublicense or white-label the service without our written agreement, or attempt to reverse-engineer it;
- probe, scan or attempt to reach another workspace’s data, or otherwise interfere with the service’s operation.
A publicly listed business contact detail is not evidence of consent to be marketed to. Deciding whether you have a lawful basis to contact somebody is your decision, and we do not make it for you.
4. Mailboxes, LinkedIn and other accounts you connect
You may only connect accounts you own or are authorised to operate. Your use of those accounts remains subject to their own provider’s terms — Google’s, your mail provider’s, LinkedIn’s — and nothing here overrides them.
Automated activity on a social platform carries a risk of restriction that we can reduce but cannot remove. We pace actions, ramp new accounts slowly, and stop an account the moment we see a warning rather than retrying through it. We do not promise that an account will not be restricted, and we are not liable if one is.
Where a feature runs on a provider key you connect, that provider bills you directly and their terms govern that relationship.
5. Your data
Your content — your contacts, lists, templates, campaigns and the messages you write — remains yours. You grant us the licence needed to host, process and display it in order to run the service for you, and nothing more. We do not sell it and we do not use it to train AI models.
You are responsible for having the right to upload what you upload, and for the accuracy of it.
6. Plans, billing and what we will not charge for
Paid plans are billed in advance through our payment processor, per the unit shown on the pricing page — a CRM seat is a person, a mailbox is a mailbox, a LinkedIn account is an account. Upgrades apply immediately; downgrades apply at the end of the period you have already paid for.
Nothing that is not built is billed. Products listed as in development on the pricing page state so, and start billing on the day they ship, not before.
Recurring payments in India are collected under a mandate you authorise, with the pre-debit notification your bank requires. A mandate is authorised up to a ceiling; if your plan grows past it you will be asked to authorise a new one rather than having a payment silently fail.
Fees already paid are non-refundable except where the law requires otherwise. You can cancel at any time and keep access until the end of the period you have paid for.
7. Availability
We work to keep the service available and we do not currently offer a contractual uptime guarantee. The service is provided on an “as is” and “as available” basis.
Parts of the platform depend on third parties — your mail provider, a social platform, a data provider, a model provider, a public map database. When one of those is slow, rate-limiting us, or refusing a request, the affected feature will say so rather than failing silently, but we cannot make it available.
We may change, suspend or discontinue features. Where a change materially reduces what a paid plan provides, we will give account holders reasonable notice.
8. Suspension and termination
You may stop using the service and cancel at any time. We may suspend or terminate a workspace that breaches section 3, that puts the service or other customers at risk, or that has not paid. Where circumstances allow, we will warn you first and give you a chance to put it right.
On termination you can ask us to export or delete your data as described in the Privacy Policy.
9. Warranties and limitation of liability
To the extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that any lead is accurate or reachable, or that any campaign will produce a result.
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings — including loss of sending reputation, deliverability, or the restriction of a third-party account.
Our total aggregate liability arising out of or in connection with these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing here excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.
10. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from your use of the service in breach of section 3, from the content of messages you send, or from your lack of a lawful basis to contact a person you contacted through the service.
11. Changes to these terms
We may update these terms. The date at the top changes when we do, and we will tell account holders by email before a material change takes effect. Continuing to use the service after that means you accept the updated terms.
12. Governing law and jurisdiction
These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising out of or in connection with them, and you and we submit to that jurisdiction.
If any provision is held unenforceable, the rest continues in effect. Our not enforcing a provision is not a waiver of it.
